Experienced Colorado Custody and Support Attorney

Custody

At Gilbert O. Montoya Jr., P.C., in Denver, Colorado, I will work hard to protect the interests of you and your child. Call 303-412-1932 or contact me to schedule a free initial consultation to discuss your divorce and child custody case with an experienced lawyer.

Protecting Children’s Interests

Colorado State Courts always try to keep both parents involved in the lives of their children after a divorce. With over 30 years of experience as a divorce attorney, I advise clients regarding these issues involved in child custody cases:

  • Primary custody
  • Parenting time (visitation)
  • Relocation of a parent
  • Post decree modification of custody

Contact me to discuss your divorce and child custody case. During your free initial consultation, I will listen to your concerns and explain how the law relates to your case.

The Child Custody Process

In Colorado, Special Advocates or Child and Family Investigators make recommendations to the court regarding the ability of each parent to provide for the childs needs. I have significant experience representing clients in these cases and working with these advocates and investigators. It is important to contact me before meeting with these investigators.

I will work with you to negotiate fair child custody and parenting time plans in mediation or litigation. Once a decision has been reached, both parents are expected to follow the Custody Order.

Post Decree Modifications

Certain circumstances call for modifications to child custody and parenting time plans. For example, if the parent who was granted primary custody wants to relocate, certain accommodations must be made to ensure that the child will still be able to spend time with the other parent. I will fight to obtain a fair decision regarding these situations.

Colorado Child Support

Colorado courts take a number of factors into consideration when determining child and spousal support orders. At the Colorado law firm of Gilbert O. Montoya, Jr., P.C., I will provide aggressive, compassionate and confidential representation if your divorce involves child support or alimony. As an experienced family lawyer, I will guide you through the complicated system to reach a fair solution. Contact me to schedule a free initial consultation.

In deciding how much child support one parent should pay, these factors are considered:

  • Combined incomes of both parents
  • Adjusted gross income of each parent
  • Amount of time the child spends with the non-residential parent
  • Daycare costs
  • Special medical expenses
  • Insurance

A Child Support Order will be issued by the court that outlines the financial responsibilities of both parents. A modification of support may take place in the event of a major change in circumstances. For example, if one parents loses his or her job, or if one of their salaries drastically changes, the Child Support Order may be changed to reflect the new situation.

Contact me to discuss your divorce and child support case. I will aggressively represent your rights and the rights of your child in litigation and mediation. Every client’s situation is unique, and I will approach your case with compassion and confidentiality to reach a positive outcome.
