Experienced Colorado Criminal Lawyer

Criminal Law

If you are facing criminal charges, an experienced attorney can defend your rights and protect your future. I have over 30 years of experience representing clients in criminal cases, such as:

  • DUI and other alcohol-related charges
  • Domestic violence
  • Drug charges

Contact me before talking to investigators. I will explain how the law applies to your case and protect your rights throughout the process.

Colorado Drunk Driving Defense Lawyer

Alcohol-related convictions such as driving under the influence (DUI) and driving while ability impaired (DWAI) can have a serious impact on your future. At Gilbert O. Montoya Jr., P.C., in Denver, Colorado, I work hard to protect my clients’ driving privileges and minimize the negative effect of these charges. I have defended clients against these charges for over 30 years.

Consequences of Drunk Driving

If you have been pulled over for drunk driving and received a DUI or DWAI in Colorado, you need to act quickly to protect your driving privileges. You must apply for a hearing within 7 days of the incident to prevent your license from being suspended or revoked.

If you license is suspended, I will help you apply to get a probationary license so that you can travel to and from work and maintain your livelihood.

If your blood alcohol content was .20 or above, you will be required to spend some time in jail. The maximum punishment for a conviction of DUI in Colorado is:

  • One year in jail
  • $1,000 fine
  • 96 hours of useful public service
  • Alcohol evaluation
  • Alcohol education course
  • 86 hours of alcohol therapy

Colorado is taking these charges more seriously than in the past. Contact me to help you minimize these consequences.

Colorado DUI/DWAI Defense

There is an administrative and criminal process involved with drunk driving charges. I will represent you in both to protect your driver’s license and defend you against the criminal DUI or DWAI charges.

I will question the officers’ traffic stop. Did they have probably cause to arrest you and follow proper procedures? I will also challenge the validity of any blood or breath tests performed at the scene.

If you have been convicted of drunk driving before, or if you have a commercial driver’s license (CDL), contact me as soon as possible. The consequences for a repeat offender or commercial driver can be substantially graver than those for a first time offender.

Colorado Domestic Violence Defense Attorney

At the Denver, Colorado, law firm of Gilbert O. Montoya Jr., P.C., I have defended clients against domestic violence charges for over 30 years. If domestic or spousal abuse charges are threatening your family and your future, contact me. I will provide compassionate, confidential, aggressive representation to protect your rights.

Crimes That Could Be Considered Domestic Violence

Domestic violence is not limited to crimes committed against one’s spouse, nor does it only include physical abuse. All of these behaviors could lead to domestic violence charges:

  • Disorderly conduct
  • Disturbing the peace
  • Destruction of property
  • Physical abuse
  • Verbal or non-verbal threatening behavior
  • Stalking

In Colorado, any criminal charge that involves a person with whom you have (or have had in the past) an intimate relationship is considered domestic violence. This means that even if you have not threatened or assaulted another person, domestic violence charges could still be filed. Contact me to schedule a free initial consultation to discuss your domestic violence defense.

Restraining Orders

When domestic violence charges are filed, a restraining order will be issued automatically. If a restraining order has been issued preventing you from returning to your home, you need an experienced attorney to protect your rights. It is not easy to obtain a modification to a restraining order, but your chances are significantly higher with a lawyer on your side.

Drug Charges

You Need an Experienced Attorney

Domestic violence charges can create a great burden on your family. I can protect your rights in negotiation and in the courtroom. Contact me if you have any questions about your rights.
